"Esta sala debe resaltar que constituye un prinipio universal del derecho, que vincula a los Tribunales, el que no permite que las partes en el proceso se comporten, de manera contraria a condutas procesales previas, concluyentes e incompatibles con esta actuación. Dicho principio proviene, como sabemos, del **Derecho Intermedio** y ha sido también aceptado por la doctrina anglosajona, bajo la figura del "estoppel"....."
