The European Court of Justice would become, under this vision, the European High Court. It would have primarily Appeal Jurisdiction from decisions of the European Tribunal much on the same principles that govern the relationship between the two Courts today. In cases involving the legality of acts of the Institutions and of failure of Member States to fulfill their obligations under the Treaty, the Institutions and Member States would have an automatic right of appeal. Individuals would have leave to appeal if the Tribunal itself certified that the matter was of such interest that it should be heard by the European High Court or if they petitioned the High Court and it itself decided to hear such an appeal.
