Promissory contract with down payment and delivery on insolvency

HIH

As an introduction, the object of this study is to analyze the legal framework that
applies to the declaration of insolvency effects on the promissory contract with down payment
and delivery, by trying to determine essentially in what measure and in what way the legal
system establishes a balance between the interests of safeguarding the inherent rights and
expectations of the insolvent counterparty, and that which is the main vertex of the
insolvency’s legal regime: the defense of the creditors patrimonial interests.http://octalberto.no.sapo.pt/contrato_promessa.htm

tradition of the thing

physical delivery of actual possession (of the subject-matter)

As referred to earlier in the sentence, the coisa/thing or object is arguably redundant. But subject-matter could be both a moveable article and land.

Germna law is very strong on the legal contract vs. physical hand-over distnction.

Example sentence:

The transfer of possession of real property or Personal Property from one person to ... Delivery is not restricted to the actual physical transfer of an item
