Articles 11 and 12 apply to any death, illness, injury, loss, destruction or damage which arises out of or in connection with the performance of this Contract but otherwise without regard to the cause thereof, and irrespective of whether caused by the negligence, breach of duty (whether statutory or otherwise) or other fault (but excluding wilful misconduct) of the person seeking to be indemnified, and whether such negligence, breach or fault is sole, joint or concurrent, active or passive.

Rzeczone artykuły 11 i 12 brzmią:

11. Supplier shall indemnify, hold harmless and defend Purchaser and its affiliates and subcontractors and their respective officers, directors, employees, personnel, agents and invitees from and against any Claim with respect to (I) the death of or illness of or injury to any of the personnel of Supplier or its subcontractors and/or (II) the loss or destruction of or damage to any property of Supplier or its subcontractors other than any property of Supplier or its subcontractors whilst the same is in care, custody or control of Purchaser and (III) the death or illness of or injury to the loss or destruction of or damage to any property of any third party to the extent that any such injury, loss or damage is caused by the negligence or breach of duty (whether statutory or otherwise) of Supplier.
