Dies erscheint ebenfalls fraglich: Die Rechtsmittelobliegenheit in Art. 34 Nr. 2 Brüssel l-VO ist Ergebnis einer streitigen Reformdiskussion und beschränkt die Rechtsprechung des EuGH zu Art. 27 Nr. 2 Brüssel I-Übk, die eine solche Obliegenheit verneint hatte. Vor diesem Hintergrund ist das Fehlen einer vergleichbaren Einschränkung in Art. 34 Nr. 1 Brüssel l-VO eher e contrario denn in Analogie argumentierend zu verstehen.

obligation to exhaust legal remedies
The doctrine of exhaustion of remedies prevents a litigant from seeking a remedy in a new court or jurisdiction until all claims or remedies have been exhausted (pursued as fully as possible) in the original one. The doctrine was originally created by case law based on the principles of comity.

In principle, I agree with you; but an obligation to execute legal remedies only makes sense in case the relevant legal remedies are favourable for the defendant.
