Cst. Tremblay observed that Mr. McKenna was “functionally intoxicated”
but polite during this encounter and his subsequent arrest. Though she initially arrested
him for assault with a weapon, Cst. Tremblay arrested Mr. McKenna for murder
following the arrival at the scene of the paramedics and other officers, and re-cautioned
and re-Chartered him for that charge. At trial, the jury heard evidence from four expert
witnesses including a forensic pathologist, an expert in the operation and identification of
firearms, an expert in DNA typing and procedures, and a forensic identification
specialist. Mr. McKenna did not testify, though there was evidence given by persons who
had seen Mr. McKenna on the day in question, Mrs. Blair, and various police officers.
