Dutch term

Afstand

Dutch to English Law/Patents Law (general)
"aanlegster vraagt akte van haar afstand van geding in toepassing van artiikel 820 Grerechtelijk Wetboek".
Is this waiving their right of the main action brought and requesting official notification of this? I have found Article 820 but am not sure of its implication. Any help most welcome.
Proposed translations (English)
3 +1 Deed of waiver
4 +1 waiver
1 withdrawal

Discussion

Mark Shimmin (asker) Feb 5, 2007:
Vic, cjguy has beaten me to it. That is the precise wording I found. If you need more details of the case as background please do ask. Thanks for posting Article 820 cjguy.
CJG (X) Feb 5, 2007:
Art 820:
Bij afstand van geding ziet de partij af van de rechtspleging die zij is begonnen met een hoofdvordering of met een tussenvordering. Afstand van geding heeft niet ten gevolge dat het recht zal worden prijsgegeven.

Suspend proceedings?
vic voskuil Feb 5, 2007:
Your interpretation is probably correct, but could you post 820 here just to be sure (or at least give it a try to read it:)

Deed of waiver

Example sentence:

Plaintiff requests deed of waiver in the action in accordance with ..

waiver

Sounds like the party is waiving its right to litigate, asking that the waiver be entered into the record.

withdrawal

I´m well out of my depth here, but might just as well give you my shot, which runs roughly thus:
"Plaintiff/Applicant (I have no idea what an aanlegster/aanlegger is) asks it to be entered into the records that she withdraws from litigation...etc"

hope it helps

I just re-read the posting of 820 at the top of the page, and a bit more careful than i should have done before, in which case I wouldn´t have posted this, since I assume a withdrawal does have as a consequence that "het recht zal worden prijsgegeven"....

Still hate drowning in legalese :)
