Tengo un amigo inglés (como yo) que está intentando vender su piso en Barcelona. Me dice que el edificio tiene una afectación y por lo tanto los compradores no pueden conseguir su hipoteca. Alguien nos puede explicar lo que es una afectación en este contexto? Gracias!

En España cuando una infraestructura (línea eléctrica, tubería, carretera...) afecta a propiedades privadas se realiza una Relación de Bienes y Derechos Afectados (RBDA). Pues bien, en EE. UU. y otros países a estas afecciones se las llama Rights of Way (ROW) y como curiosidad diré que es rarísimo que se llegue a dar una expropiación.
Si es el edificio el "afectado" me inclinaría por algún problema relacionado con lo urbanístico, municipal, etc. Si es el "piso" el afectado, me inclinaría por algún problema inhente a un solo particular, que pudo haber creado una hipoteca, tenerlo sujeto a "vivienda familiar", con lo cual no puede crearse una hipoteca.
Averigua en España sobre "afección de inmuebles" para saber si cuadra con tu contexto.

Obviamente, es lo q expliqué. Si es el "edificio" podría ser "right of way", si es el depto. significaría alguna otra cosa (bien de familia, segunda hipoteca, etc)

actually it does seem to imply some sort of structural damage/ infringement, vis this (I googled 'afectacion en un piso'!)
Hola, no se si podras responder a mi pregunta. Estoy planteando comprar un piso en Barcelona que tiene una afectación desde hace mucho tiempo (tipica afectacion urbanistica, el edificio no respeta la linea de cera que se trazo posteriormente a su construcción). Quisiera saber en que condiciones puede darme el banco la hipoteca y en caso de que el ayuntamiento lleve a cabo la afectacion y habiendo comprado el piso sabiendo ya que estaba afectado a que tipo de compensación tendría derecho. Gracias.
