Hearing in open court
27.—(1) Every contested appeal shall be heard in open court except where it is necessary in the interests of justice or in the public interest to sit in private for part of an appeal hearing.
(2) Where the Court considers it necessary for a party and that party’s representative to be excluded from a hearing or part of a hearing in order to secure that information is not disclosed contrary to the public interest, the Court must conduct the hearing, or that part of it from which the party and the representative are excluded, in private but the Court may exclude a party and any representative only if a person who has been appointed as a special advocate to represent the interests of that party is present when the party and the representative are excluded.
(3) Where the Court decides it is necessary for the Court to sit in private, it shall announce its reasons for so doing publicly before the hearing begins.
(4) Hearings shall be conducted in accordance with—
(a) the relevant practice direction, and
(b) any directions given by the Court and directions given by the Court may limit oral submissions to a specified duration.
Judgment
28. A judgment may be—
(a) delivered in open court; or
(b) if the Court so directs, promulgated by the Registrar.
Orders
29.—(1) In relation to an appeal or a reference, the Supreme Court has all the powers of the court below and may—
(a) affirm, set aside or vary any order or judgment made or given by that court;
(b) remit any issue for determination by that court;
(c) order a new trial or hearing;
(d) make orders for the payment of interest;
(e) make a costs order.
(2) An order of the Supreme Court may be enforced in the same manner as an order of the court below or of the appropriate superior court.
(3) For the purposes of paragraph (2) “the appropriate superior court” means—
(a) in the case of an appeal or reference from a court in England and Wales, the High Court;
(b) in the case of an appeal or reference from a court in Scotland—
(i) where the appeal or reference is in civil proceedings, the Court of Session; and
(ii) where the appeal or reference is in criminal proceedings, the High Court of
Justiciary;

(c) in the case of an appeal or reference from a court in Northern Ireland, the High Court in
Northern Ireland.
(4) In the case of references other than those mentioned in paragraph (3) “the appropriate superior court” in paragraph (2) means—
(a) where the reference is under the Scotland Act 1998, the Court of Session;
(b) where the reference is under the Northern Ireland Act 1998, the High Court in Northern
Ireland.

27.—(1) Toda apelación en segunda instancia deberá ser llevada a cabo en un juicio oral excepto cuando sea del interés público o de la justicia que sea privada para un momento determinado de la audiencia de apelación.
(2) Cuando la Corte considere necesario excluir a una parte y a su representante de la audiencia, o de una parte de ésta, para asegurarse de que la información no sea revelada contraria al interés público, la Corte deberá realizar una audiencia, o esa parte de ella en la cual la parte y su representante son excluidos, en privado. Sin embargo, la Corte puede excluirlos solo en el caso de que esté presente la persona que se haya designado como abogado con facultades extraordinarias para representar los intereses de la parte.
(3) Cuando la Corte decida que es necesario reunirse en privado, deberá anunciar sus razones públicamente antes del comienzo de la audiencia,
(4) Las audiencias se realizarán en conformidad con:
(a) a las normas procesales, y

Decretos
29.—(1) En relación a una apelación o una referencia, la Corte Suprema tiene todos los poderes de un tribunal inferior y puede:
(a) afirmar, anular o modificar cualquier sentencia o fallo establecido o promulgado por esa corte;
(b) remitir cualquier asunto para que sea determinada por esa corte;
(c) solicitar un nuevo juicio o audiencia;

(e) imponer costas.

1 I APPOINT my mother THE HONOURABLE MRS FRANCES RUTH SHAND KYDD of Callinesh Isle of Seil Oban Scotland and COMMANDER PATRICK DESMOND CHRISTIAN JERMY JEPHSON of St James's Palace London SW1 to be the Executors and Trustees of this my Will
2 I WISH to be buried.
3 SHOULD any child of mine be under age at the date of the death of the survivor of myself and my husband I APPOINT my mother and my brother EARL SPENCER to be the guardians of that child and I express the wish that should I predecease my husband he will consult with my mother with regard to the upbringing education and welfare of our children
4 (a) I GIVE free of inheritance tax all my chattels to my Executors jointly.
(b) I DESIRE them:
(i) To give effect as soon as possible but not later than two years following my death to any written memorandum or notes of wishes of mine with regard to any of my chattels
(ii) Subject to any such wishes to hold my chattels in accordance with Clause 5 of this my Will
(c) FOR the purposes of this Clause "chattels" shall have the same meaning as is assigned to the expression "personal chattels" in the Administration of Estates Act 1925.
(d) I DECLARE that all expenses for the safe custody of and insurance incurred prior to giving effect to my wishes and for packing transporting and insurance for the purposes of the delivery to the respective recipients of their particular chattels shall be borne by my residuary estate
5 SUBJECT to the payment or discharge of my funeral testamentary and administration expenses and debts and other liabilities I GIVE all my property and assets of every kind and wherever situate to my Executors and Trustees Upon trust either to retain all or any part in the same state as they are at the time of my death or to sell whatever and wherever they decide with power when they consider it proper to invest trust monies and to vary investments in accordance with the powers contained in the Schedule to this my Will and to hold the same UPON TRUST for such of them my children PRINCE WILLIAM and PRINCE HENRY as are living three months after my death and attain the age of twenty five years if more than one in equal shares PROVIDED THAT if either child of mine dies before me or within three months after my death and issue of that child are living three months after my death and attain the age of twenty one years such issue shall take by substitution if more than one in equal shares per stripes the share that the deceased child of mine would have taken had he been living three months after my death but so that no issue shall take whose parent is then living and so capable of taking.

Además de variar la forma de inversión de acuerdo con los poderes estipulados en el codicilo de éste, mi testamento, y mantener el mismo en fideicomisos para cada uno de ellos, mis hijos; Príncipe Guillermo y Príncipe Enrique, en partes iguales, si es más de uno, en la medida en que se encuentren con vida tres meses después de mi deceso y cumplan la edad de veinticinco años. En el caso de que uno de mis hijos fallezca antes que yo o tres meses después de mi muerte y su descendencia se encuentre con vida tres meses después de mi deceso y haya cumplido veintiún años de edad, ésta se beneficiará de la parte que le correspondía a mi hijo, si es más de uno, en partes iguales por estirpe. Dicha descendencia no podrá reclamar esta parte en el caso de que su padre se encuentre con vida y sea capaz de reclamarla.
