RESUMO
Neste trabalho apresento os dados acerca de uma pesquisa sobre a atuação do Conselho da Comunidade de Porto Alegre (CCPOA), e sobre a forma como se estabelece a relação do conselho com a comunidade no processo de ressocialização do preso, permeando, assim, o que tange as políticas públicas e o debate sobre leis e direitos. Para a realização da pesquisa partiu-se de uma revisão de parte da bibliografia produzida acerca do assunto, assim como se visitou o Conselho Penitenciário do Estado do Rio Grande do Sul, localizado em Porto Alegre, em busca de mais informações sobre o CCPOA. Com os estudos realizados percebe-se a importância, mais do que nunca, que olhar a legislação no sentido de transformar as leis realmente em direitos, pois as violações dos direitos dos presos é resultado dessa situação de precarização e descaso dos governos e da sociedade em geral. É necessário que a sociedade conheça mais sobre o assunto e possa na medida do possível cooperar com atividades de prevenção, reeducação e reinserção social dos apenados, pois entende-se que na situação atual o preso acaba tendo, quando em liberdade, uma “pena paralela”.

Como proposta de estudo acerca da Criminologia e do Direito Penal, assim como sobre as políticas públicas que permeiam esses assuntos, propõe-se uma discussão acerca de alguns tópicos, como legislação (Constituição Federal, Código Pena, Processual e Execuções Penais), assistência social, reabilitação e conselhos.
Portanto, o presente trabalho visa investigar como é a atuação do Conselho da Comunidade de Porto Alegre (CCPOA), e como se estabelece a relação do conselho com a comunidade no processo de ressocialização do preso, permeando, assim, o que tange as políticas públicas e o debate sobre leis e direitos.
Para a realização da pesquisa partiu-se de uma revisão de parte da bibliografia produzida acerca do assunto, assim como se visitou o Conselho Penitenciário do Estado do Rio Grande do Sul, localizado em Porto Alegre, em busca de mais informações sobre o CCPOA.
2. FUNDAMENTAÇÃO TEÓRICA
Para iniciar a discussão a respeito do processo de ressocialização do preso a partir da perspectiva do Conselho de Porto Alegre, pretende-se introduzir o debate acerca da Constituição Federal (CF) de 1988 e do conceito da dignidade da pessoa humana.
A CF (1988) mudou a forma como o estado e a sociedade se organizam, sendo garantidos direitos e garantias fundamentais e importantes de serem analisados para compreender a realidade estudada, dentre eles o princípio da dignidade do ser humano, previsto no artigo 1º, inciso III da Constituição da República Federativa do Brasil, que é o objeto de estudo do presente trabalho.
Com efeito, quando se fala a respeito desse tema têm-se como referência o autor Peter Häberle que explica ser necessário o entendimento dos direitos fundamentais com uma amplitude que se conecta com a dignidade do ser humano, sendo proibido o tratamento desumano, tortura, trabalhos forçados, pena de morte, assim como garantida a proteção da integridade física e moral (COELHO, 1998).
A dignidade da pessoa humana é presente em diversos documentos constitucionais ao redor do mundo, onde conversam com o exposto pela Constituição Brasileira de 1988 que diz que as pessoas têm a mesma dignidade e cabe ao Estado promover a dignidade da pessoa humana, conforme elenca Frias e Lopes:
Ao longo do século XX a dignidade da pessoa humana se tornou um princípio presente em diversos documentos constitucionais e tratados internacionais, começando pela Declaração Universal dos Direitos Humanos (1948) e se espalhando pelo Pacto Internacional sobre os Direitos Econômicos, Sociais e Culturais (PIDESC) (1976) e pelas constituições de Itália (1947, art. 3º), Alemanha (1949, art. 1º), Portugal (1976, art. 1º), Espanha (1978, art. 10), Grécia (1975, art. 7º), Peru (1979, art. 1º), Chile (1980), Paraguai (1992, art. 1º), Bélgica (após a revisão de 1994, art. 23) e Venezuela (1999, art. 3º), dentre diversos outros pactos, tratados, declarações e constituições (2015, p. 653).
A partir dessas discussões, entende-se que a Constituição Federal e os órgãos estatais precisam estar em sintonia para garantir o funcionamento da sociedade em sintonia com a Constituição Federal, onde Leticia das Neves (2008) aponta, para a importância do cumprimento, também, no âmbito do sistema penitenciário principalmente para garantir direitos a população carcerária.

Para auxiliar na construção desse olhar, principalmente para as visitas aos órgãos, é preciso entender como e onde a dignidade da pessoa humana está inserida, olhar também para os conceitos que caminham junto nos direitos fundamentais, pois são a base do direito brasileiro, conforme demonstrado na figura acima (PITASSI; FERREIRA, 2019).
A participação da comunidade na gestão penitenciária e na construção de ações em defesa dos direitos humanos torna-se um instrumento importante para evitar as cotidianas violações sofridas por parcela significativa da população, que, por diversos motivos, não dispõe de recursos para acessar o aparato legal e judiciário.
Portanto, o Conselho da Comunidade de Porto Alegre (CCPOA) visa:
dar apoio social e material para a população carcerária que se encontra nas casas prisionais da Capital. Os membros da entidade são responsáveis pela elaboração de visitas a estabelecimentos penais, apresentação de relatórios e obtenção de recursos materiais e humanos a essas instituições (BRASIL, 2023, p.1).
Nesse sentido, destaca-se a importância desse Conselho para garantir às pessoas privadas de liberdade que possam acessar um novo tipo de cumprimento de pena, com mais dignidade, independentemente da condição econômica, social e embasado nas políticas publicas.
Luiz Henrique Viana (secretário da SSPS) afirma que o cumprimento da pena deve ser guiado pela igualdade e pela dignidade da pessoa humana. A presidente do CCPOA, Nilsa Teresinha Capiem de Figueiredo complementa a discussão argumentando que esse trabalho de ressocializar deve iniciar dentro da prisão para que os presos saiam em uma condição melhor quando em liberdade (BRASIL, 2023).
Como deveres do Conselho inclui-se realizar visitas mensais aos estabelecimentos penais para começar o trabalho de atenção, assim como entrevistar os presos, apresentar relatórios mensais ao juiz da execução e ao Conselho Penitenciário a fim de garantir melhores recursos humanos e materiais na assistência ao preso internado (PORTO ALEGRE, 2014).
3. METODOLOGIA
No mês de Abril e Maio de 2023 realizaram-se visitas ao Conselho Penitenciário do Estado do Rio Grande do Sul, localizado no centro histórico de Porto Alegre – RS. O objetivo das visitas era de poder observar um pouco da rotina e da atuação do conselho, mas principalmente de colher informações a respeito do Conselho da Comunidade de Porto Alegre.

Na visita realizadas não foi permitido tirar fotos das pessoas e nem do interior do local e nem fazer qualquer tipo de gravação de áudio/vídeo. Mas, foi possível colher algumas informações no que compete o objetivo desse trabalho, como algumas indicações de materiais e links sobre a atuação do Conselho.

As fotos acima são do Natal de 2022, onde o Conselho da Comunidade de Porto Alegre (Ccpoa) realizou algumas ações voltadas às pessoas privadas de liberdade, assim como para os servidores em unidades prisionais da Capital, as fotos são da penitenciária Madre Pelletier (BRASIL, 2022).
As próximas fotos são de um evento recente de inauguração oficial da Central Integrada de Alternativas Penais (CIAP) de Porto Alegre na sala do foro conselho da comunidade de porto Alegre onde houve debater muito importantes acerca dos temas trabalhados nesse trabalho (BRASIL, 2023).

4. RESULTADOS E DISCUSSÕES
A partir das visitas realizadas, assim como a revisão bibliográfica feita consegue-se compreender um pouco melhor como o Conselho da Comunidade de Porto Alegre atua e os objetivos que pauta em direção da ressocialização do preso e do auxílio às famílias.
No funcionamento, o Conselho da Comunidade têm pastas nas quais cada atendido tem sua ficha com seus registros, incluindo a informação sobre pertencer ou não a uma facção (que serve apenas para informação de cadastro). Sobre a prestação de contas desse órgão é encaminhada ao juiz responsável, mas também pode ser acessada pela sociedade em geral (CAMPOS, 2021).
Ainda segundo Campos (2021) o Estado do Rio Grande do Sul conta atualmente com 82 Conselhos da Comunidade ativos que funcionam como um elo entre os presídios e a comunidade, pois as visitas realizadas permitem conhecer a realidade das prisões, assim como os apenados, suas famílias e agentes penitenciários.
Uma coisa que percebe-se como importante a se destacar é que existe uma visão na sociedade que entende que as pessoas que cometeram delitos merecem unicamente serem punidas, não sendo considerada a ressocialização e, sim, o castigo. Segundo Garland (2005) os últimos anos apresentaram mudanças importantes que permitiram práticas meramente punitivas serem socialmente aceitas, com caráter simplesmente retributivo (CAMPOS, 2021).
Sendo assim, é dever do Conselho da Comunidade de Porto Alegre combater essas visões e buscar atender aos apenados e seus familiares, podendo auxiliar em necessidades e como intermediário em diversas situações, sejam cotidianas (de estrutura, como de uma família em situação de vulnerabilidade) ou de legislação (CAMPOS, 2021).
O Conselho pode promover iniciativas que visem a capacitação e a busca por vagas e oportunidades de emprego para pessoas que estão cumprindo pena e/ou que já são egressos.
5. CONSIDERAÇÕES FINAIS
Observou-se, principalmente nas discussões feitas em campo, no Conselho Penitenciário do Estado do Rio Grande do Sul, que a situação prisional é na maioria das vezes crítica, pois há uma superlotação na maior parte dos presídios, o que impossibilita o uso adequado das estruturas.
É a partir dessa situação delicada e de precarização no âmbito do sistema penitenciário que partem as ações do Conselho de Porto Alegre, portanto é importante pensar no contexto histórico e social.
Com os estudos realizados percebe-se a importância, mais do que nunca, que olhar a legislação no sentido de transformar as leis realmente em direitos, pois as violações dos direitos dos presos é resultado dessa situação de precarização e descaso dos governos e da sociedade em geral.
É necessário que a sociedade conheça mais sobre o assunto e possa, na medida do possível, cooperar com atividades de prevenção, reeducação e reinserção social dos apenados, pois entende-se que na situação atual o preso acaba tendo, quando em liberdade, uma “pena paralela”.
Nesse sentido essas instituições, como o Conselho de Porto Alegre, aproximam a sociedade e as comunidades do universo carcerário, principalmente para que possam contribuírem nas discussões de políticas públicas e de segurança e que visem a reinserção dessa população na sociedade (CAMPOS, 2021).
Entende-se que não será possível esgotar as discussões acerca do tema proposto, mas objetiva-se a partir dessa investigação do Conselho Penitenciário do Estado do Rio Grande do Sul e do Conselho de Porto Alegre contribuir para os estudos feitos e questionar a forma como o sistema penitenciário está trabalhando para priorizar a dignidade humana nos presídios e o processo de ressocialização dos presos.

In this work, I present the data from a search about the actuation in the Community Council from Porto Alegre (CCPOA), and about the way it is established the council relation with the community in the process of the arrested resocialization, permeating, thereby, what about public policy and the laws and rights debate. To realize the search, we started with a review of a bibliography part produced on the subject, just like visited the Penitentiary Council from the Rio Grande do Sul state, located in Porto Alegre, looking for more informations about the CCPOA. With the realized studies, we understand the importance, more than ever, that look the legislation in the sense of transforming the laws in rights, cause the arrested rights violations is result of that precariousness and neglect from the governments and the society in general. Is necessary that the society knows more about the subject, and can as far as possible cooperate with the activities of prevention, reeducation and social reinsertion from the remands, cause it is understood that in the actual situation the arrested ends up having, when in freedom, a "parallel sentence".

As a proposal study about the Criminology and the Criminal Law, even as de public policy that permeate these matters, it is proposed as a discussion about some topics, as legislation (Federal Constitution, Penal Code, Procedural and Penal Executions), social assistance, rehabilitation and councils.
Therefore, the present work aims to investigate how is the actuation of the Community Counsel of Porto Alegre (CCPOA), and how it is established the council relation with the community in the process of resocialization of the prisoner, permeating, in that way, what concerns the public policy and the debate about laws and rights.
To realize the search, we started with a review of a bibliography part produced on the subject, just like visited the Penitentiary Council from the Rio Grande do Sul state, located in Porto Alegre, looking for more informations about the CCPOA.
2. THEORETICAL GROUNDS
To start the discussion about the resocialization process of the arrested from the perspective of the Council of Porto Alegre, it is intended to introduce the debate about the Federal Constitution (CF) of 1988 and the concept of the human dignity.
The Federal Constitution (1988) changed the form as the state and the society organize themselves, being assured rights and fundamental guarantees and important of being analyzed to understand the reality studied, among them the dignity principle of the human being, provided in the 1° article, item III of the Constitution of the Federative Republic of Brazil, that is study object in the present work.
With effect, when talking about this theme we have as reference the author Peter Häberle that explains the necessary understanding of fundamental rights as an amplitude that connects with human dignity, being forbidden the dehumanizing treatment, torture, hard labor, death penalty, as guaranteed protection of the physical integrity and moral (COELHO, 1998).
The Human Dignity it's present in several constitutional documents around the world, where speak with the disposed in the Brazilian Constitution of 1988 that says that people have the same dignity and it's up to the State promote the dignity of human being, as lists Frias and Lopes:
Over the XX century the dignity of the human being became a principle present in many constitutional documents and international treatments, beginning with the Universal Declaration of the Human Being (1948) and spreading out with the International Pact of the Economic Rights, Civil and Cultural (PIDESC) (1976) and for the constitutions of Italy (1947, art. 3°), Germany (1949, art. 1°), Portugal (1976, art. 1°), Spain (1978, art. 10°), Greece (1975, art. 7°) Peru (1979, art. 1°), Chile (1980), Paraguay (1992, art. 1°), Belgium (after the 1994 revision, art. 23) and Venezuela (1999, art. 3°), among a several other pacts, treatments, declarations and constitutions (2015, p. 653).
From these discussions, it is understood that the Federal Constitution and the state bodies needs to be in tune to guarantee the operation of society in tune with the Federal Constitution, where Letícia das Neves (2008) points, to the performance importance, as well, within the penitentiary system to guarantee rights to the prison population.

To assist in the construction of this look, mostly to visits to the public organs, it's needed to understand how and where the dignity of human being is insert, look too the conceits that walk together in the fundamental rights, cause they are the brazilian rights base, as demonstrated in the figure above (PITASSE; FERREIRA, 2019).
The community participation in the penal management and in construction of actions in defense of human rights becomes an important instrument to avoid the daily violations suffered by a significant portion of population, that, for many reasons, does not have the resources to access the legal and judiciary apparatus.
Therefore, the Community Council of Porto Alegre (CCPOA) visa:
give social and material support to the prison population that is found in prison houses in the capital. The entity members are responsible for elaboration of visits to penal establishments, report presentations and obtaining material and human resources to that institutions (BRAZIL, 2023, p. 1).
In that way, stands out the importance of that Council to guarantee to people deprived of liberty that can access a new type of sentence serving, with more dignity, independent of the economic and social condition, grounded on public policy.
Luiz Henrique Viana (secretary on SSPS) affirms that the fulfillment of the sentence must be guided for equality and dignity of the human being. The CCPOA president, Nilsa Teresinha Capiem de Figueiredo complement the discussion arguing that this resocialize work must start inside the prison so that the prisoners leave in a better condition when in liberty (BRAZIL, 2023).
As duties of the Council it is included to realize monthly visits to the penal establishments to start the attention work, as well as interview the arresteds, present monthly reports to the execution judge and to the Penal Council in order to guarantee better human and material resources in assistance to the interned prisoner (PORTO ALEGRE, 2014).
3. METHODOLOGY
In the month of April and May 2023 have been realized visits to the Penitentiary Council of the Rio Grande do Sul state, localized in the historic center of Porto Alegre - RS. The objective of the visits was able to observe the routine and the council actuation a little, but principally to gather information about the Community Council of Porto Alegre.

In the visit realized was not allowed to make pictures of the people, inside the place and not even make any type of audio/video recording. But, it was possible to reap some information in what competes the objective of that work, as some material indications and links about the Council actuation.

The pictures above are from the Christmas 2022, where the Community Council of Porto Alegre (Ccpoa) realized some actions aimed at persons deprived of liberty, as well as to the servers in prison units of the Town, the pictures are from the Madre Pelletier Penitentiary (BRAZIL, 2022).
The next pictures are about a recent event of official inauguration of Integrated Center of Penal Alternatives (CIAP) of Porto Alegre in the court room of the community council of Porto Alegre where there were very important debates about the themes worked on that work (BRAZIL, 2023).

4. DISCUSSIONS AND RESULTS
From the realized visits, as well as the bibliography revision made you can understand a little better how the Community Council of Porto alegre acts and the goals that guide to the prisoner rehabilitation and the families support.
In operation, the Community Council have blotters in which each serviced have his file with his registers, including the information about belonging or no to a faction (that serves only to register information). About the accountability of this organ is forwarded to the responsible judge, but also can be accessed for the society in general (CAMPOS, 2021).
Still according Campos (2021) the Rio Grande do Sul state account currently with 82 Community Councils acting that works as a link between the prisons and the community, cause the visits realized permit to know the realities in prisons, even as the prisoners, them familys and the penitentiary agents.
A thing that is noticed as important to contrast is that exist a vision in society that understand that people who committed crimes deserve merely be punished, not being considerate the resocialization and, just, the castigation. According Garland (2005) the last years presented important changes that allowed practices merely punitive be socially accepted, with character simply retributive (CAMPOS, 2021).
Therefore, it is duty of the Community Council of Porto Alegre to combat that visions and try to attend the prisoners and their families, being able to help in necessities and as intermediary in many situations, whether everyday (of structure, as a family in vulnerable situation) or of legislation (CAMPOS, 2021).
The Council can promote initiatives that aim training and the search for vacancies and job opportunities to the people that are serving time and/or that already are ex-prisoners.
5. FINAL CONSIDERATIONS
It was observed, principally in discussions done in field, at the Penitentiary Council of the Rio Grande do Sul state, that the prisonal situation is most of the time criticism, cause there's an over crowed in the most part of the prisons, that makes impossible the adequate use of structures.
It is from this delicate situation and the precariousness in the scope of the penitentiary system that the Council of Porto Alegre actions depart, therefore is important to think in the historical and social context.
With the realized studies, we understand the importance, more than ever, that look the legislation in the sense of transforming the laws in rights, cause the arrested rights violations is result of that precariousness and neglect from the governments and the society in general.
Is necessary that society knows more about the subject and can, as far as possible, cooperate with prevention activities, reeducation and social reinsertion of the convicts, cause is understood that in the actual situation the prisoner ends up having, when in liberty, a "parallel feather".
In this sense that institutions, as the Porto Alegre Council, approach the society and the communities from the prisoner universe, principally so that they can contribute in discussions of public politics and of security and that looks the reinsertion of that population in society (CAMPOS, 2021).
It is understood that won't be possible exhaust the discussions about the proposed theme, but is objectified from that investigation of the Penitentiary Council of the Rio Grande do Sul state and from the Porto Alegre Council contribute to the studies done and question the way as the penitentiary system is working to prioritize the human dignity in the prisons and the resocialization process of the prisoners.
