Source text - Ukrainian 2. ОСОБЛИВОСТІ ПРАВОВОГО РЕЖИМУ ОКРЕМИХ ВИДІВ МАЙНА
2.1. На момент укладання цього договору будь-яке майно та майнові права, що придбані до укладення та реєстрації шлюбу, а також під час перебування у зареєстрованому шлюбі, як на території України так і за її межами (в тому числі на території Королівства Нідерландів), належать на праві особистої приватної власності тому із подружжя, на чиє ім'я воно придбане, якщо інше не встановлено законодавством іноземної держави, на території якої знаходиться майно та положеннями міжнародного приватного права.
2.2. Грошові та інвестиційні вклади, внесені до банківських установ подружжям під час шлюбу, а також за інвестиційними договорами, як на території України так і за її межами, а також відсотки та компенсації до них вважаються, під час шлюбу та у випадку його розірвання, власністю того з подружжя, на чиє ім'я вони внесені, або від кого передані.
2.3. Акції та цінні папери, придбані під час шлюбу, а також дивіденди до них, належать під час шлюбу та у випадку його розірвання тому з подружжя, на ім'я якого оформлене придбання акцій та інших цінних паперів.
2.4. Речі для професійних занять, речі індивідуального користування, у тому числі коштовності, ювелірні прикраси та будь-які інші цінні речі, придбані подружжям, являються власністю того з подружжя, який ними користується.
2.5. Придбані подружжям під час зареєстрованого шлюбу посуд, кухонне начиння, побутова техніка, меблі є в період шлюбу спільною сумісною власністю подружжя, а у випадку розірвання шлюбу - власністю того з подружжя, якому належить право власності на нерухоме майно, в якому вони перебувають.
2.6. Автомобілі та інші транспортні засоби, придбані подружжям під час зареєстрованого шлюбу, є власністю того з подружжя, на чиє ім'я вони оформлені та зареєстровані.
2.7. Відшкодування збитків, відшкодування втрати (пошкодження) речі, яка належала одній зі Сторін, відшкодування завданої моральної шкоди, страхові виплати, доходи (дивіденди, плоди, приплід, продукція тощо) від майна рухомого та нерухомого, речі та майнові права, у тому числі корпоративні, та грошові кошти, премії, нагороди, отримані за особисті заслуги, а також заробітна плата, пенсія, стипендія кожної зі Сторін, одержані або нараховані в період перебування в зареєстрованому шлюбі є особистою приватною власністю тієї із сторін, кому вони присуджуються та/або виплачуються.
2.8. Майнові зобов’язання (борги), що виникли з кредитних, іпотечних та інших цивільно-правових договорів, належать тому з подружжя, хто уклав відповідний договір (від чийого імені укладено відповідний договір), якщо інше не встановлено умовами самого договору чи законом. Погашення боргів кожного з подружжя відбувається за рахунок особистого майна.
2.9. Своєю особистою приватною власністю кожна із Сторін, володіє, користується і розпоряджається на власний розсуд, вчиняє будь-які дії щодо свого майна (грошових коштів), не узгоджуючи питання з чоловіком (дружиною) навіть за умови, якщо за час шлюбу таке майно істотно збільшиться у своїй вартості внаслідок спільних трудових чи грошових затрат одного з них.
2.9. Спільною сумісною власністю подружжя є:
а) будь-яка річ, набута за час шлюбу, і не віднесена цим договором до особистої приватної власності;
б) майно, яке не підлягає державній реєстрації, у разі, якщо неможливо визначити на чиє ім’я або за чиї кошти воно набуте;
в) інші доходи, які не віднесені цим договором до особистої приватної власності, одержані одною зі Сторін і внесені до сімейного бюджету для спільного використання.
2.10. Сторони під час шлюбу та у разі його розірвання розпоряджаються майном та грошовими коштами, що є об’єктом права спільної сумісної власності подружжя, за взаємною згодою.
Договір щодо такого майна (грошових коштів) або їх використання, укладений одним із подружжя в інтересах сім’ї, створює обов’язки для другого з подружжя, якщо майно (грошові кошти), одержані за договором, використовуватимуться в інтересах сім’ї.
Translation - English 2. FEATURES OF THE LEGAL REGIME OF CERTAIN TYPES OF PROPERTY
2.1. At the time of conclusion of this contract any property and property rights acquired before conclusion and registration of the marriage, as well as during marriage, both in Ukraine and abroad (including the Kingdom of the Netherlands), belong on the rights of personal private property to that spouse in whose name it was acquired, unless otherwise provided by the laws of the foreign state where the property is located and by the provisions of the private international law.
2.2. Cash and investment deposits placed into banking institutions by the spouses during marriage, as well as under investment agreements, both in Ukraine and abroad, as well as interests and compensations to them are considered as a property of that spouse in whose name they are placed or from whom they are transferred during marriage and in the event of divorce.
2.3. Shares and securities acquired during marriage as well as dividends to them belong, during the marriage and in the event of its dissolution, to that spouse in whose name the purchase of shares and other securities has been registered.
2.4. Items for professional use, items for personal use, including jewels, jewelry and any other valuables purchased by the spouses are owned by that spouse who uses them.
2.5. Utensils, kitchen equipment, household appliances, furniture purchased by the spouses during marriage are the marital property of the spouses and in the event divorce - the property of that spouse who holds title to real property in which they live.
2.6. Cars and other vehicles purchased by the spouses during marriage belong to that spouse in whose name they are registered.
2.7. Compensation for damages, recovery of loss (indemnification) of an item owned by one of the Parties, compensation for non-pecuniary damage, insurance payments, income (dividends, profits, issues, products, etc.) from movable and immovable property, items and property rights, including corporate and monetary funds, awards, prizes received for personal merits as well as salaries, pensions, scholarships of each of the Parties received or accrued during marriage are the personal private property of that party to whom they are awarded and / or paid.
2.8. Estate liabilities (promissory notes) arising from credit, mortgage and other civil law agreements belong to that spouse who entered into the relevant agreement (on whose behalf the relevant agreement was concluded), unless otherwise provided by the terms and conditions of the agreement or the law. Reimbursement of debts of each spouse is at the expense of personal belongings.
2.9. Each of the Parties owns, uses and disposes of his/her private property at his/her own discretion, takes any action with respect to his/her property (monetary funds) without agreeing with a husband (wife) even if such property increases significantly in its value during marriage due to the common labor or financial costs of one of them.
2.9. The marital property is as follows:
a) any item acquired during the course of a marriage and not referred by this contract to the personal private property;
b) property that is not subject to state registration, if it is impossible to determine in whose name or at whose expense it was acquired;
c) other incomes received by one of the Parties and contributed to the family budget for joint use but which are not referred to the personal private property by this contract.
2.10. During marriage and in case of divorce, the parties, by mutual consent, dispose of the property and monetary funds which are the object of the right of marital property.
Such property agreement (monetary funds) or its use, executed by one of the spouses for the benefit of the family, creates obligations for the other one, if the property (monetary funds) received under the contract would be used for the benefit of the family.

Source text - Ukrainian 4.1. Діяльність через дочірнє підприємство або постійне представництво:
Відповідно до 141.4.7 ПК України суми прибутків нерезидентів, які провадять свою діяльність на території України через постійне представництво, оподатковуються в загальному порядку. При цьому таке постійне представництво прирівнюється з метою оподаткування до платника податку, який провадить свою діяльність незалежно від такого нерезидента.
У зв’язку із наведеним в даному розділі в першу чергу аналізується можливість діяльності Компанії в Україні через дочірнє підприємство із вказівкою на особливості діяльності через постійне представництво, там де це буде важливим.
4.1.1. Організаційні питання.
З точки зору ст. 39 ПК України головна Компанія та її дочірні підприємства в різних країнах світу становлять єдину міжнародну групу компаній. Якщо головна компанія чи одна з її дочірніх компаній створить дочірнє підприємство в Україні для ведення бізнесу, то це дочірнє підприємство також стане частиною цієї міжнародної групи компаній - за певних умов це може призвести до того, що замість оподаткування реального прибутку буде оподатковуватися “віртуальний прибуток” розрахований податковими органами.
Засновником українського дочірнього підприємства може виступити як Головна Компанія та і її дочірні компанії в інших країнах – відповідна компанія буде вважатися материнською компанією по відношенню до цього дочірнього підприємства. Країна реєстрації материнської компанії може мати значення, оскільки між Україною та різними країнами укладені різні міжнародні угоди про взаємний захист інвестицій, уникнення подвійного оподаткування та про правову допомогу.
Українське дочірнє підприємство може бути створено в формі товариства з обмеженою відповідальністю чи іншого виду господарського товариства. Таке товариство є юридичною особою і підлягає державній реєстрації.
Translation - English 4.1. Company’s business through a subsidiary or a permanent establishment
According to the Art. 141.4.7 of the Tax Code of Ukraine, the amounts of revenues of non-residents who conduct their business activities in Ukraine through a permanent establishment are subject to tax on general terms. In this case, such a permanent establishment is equated for tax purposes with taxpayers who conduct their business activities independently of such a non-resident.
Resulting from the above-said in this section, first of all, the ability of the Company to run its business activities in Ukraine through a subsidiary at the direction of features of activities through a permanent establishment is being researched where this may be important.
4.1.1. Organizational issues
In terms of the Art. 39 of the Tax Code of Ukraine, the parent Company and its subsidiaries in different countries of the world form a single international group of companies. If the parent company or one of its subsidiaries establishes a subsidiary for doing business in Ukraine, this subsidiary will also become part of this international group of companies - under certain conditions, this may lead to the taxation of “virtual profits” calculated by the tax authorities instead of taxing real profits.
The founder of a Ukrainian subsidiary can be both, the Parent Company and its subsidiaries in other countries - a relevant company will be considered as the parent company with respect to this subsidiary. The country of registration of the parent company may be important, as different international agreements on mutual protection of investments, avoidance of double taxation and legal assistance have been concluded between Ukraine and different countries.
A Ukrainian subsidiary may be established in the form of a limited liability company or another type of a business company. Such company is a legal entity and is subject to the state registration.

Bio
I’m a full-time qualified translator from English and French into Ukrainian and Russian. I was born and I have lived in Ukraine before the war started, in April 2022,I immigrated to Canada. I’m a Ukrainian and Russian native speaker.
Since 2003, I have been working professionally as a translator and interpreter in such fields as law (contract law), language schools, translation agency, consulting services, and marketing research, agricultural engineering, importation and distribution of alcoholic beverages, energy, and since 2016 as a teacher of English (individual lessons).
Since 2018 I’ve been working with private customers, notaries of Kyiv city notarial district, a group of law firms “Sky Group” (Kyiv Ukraine), and Law Association “Yar.Val” (Kyiv Ukraine).
Besides translation and interpreting, I do transcription, transcreation, subtitling, proofreading and editing. I currently use SDL Trados Studio 2021 and other tools to optimize my work.
In 2005, I have graduated with a Master’s degree in “Language and Literature (French)”, translator/interpreter, teacher of French and English, School of foreign languages, V.N. Karazin University in Kharkiv (Ukraine).
